Under Section 246 of the Local Government Act 1999 (SA), councils have the power to make By-Laws to support good governance and the safe, convenient use of community spaces. The District Council of Yankalilla reviewed By-Law No. 7: Cats in 2023. After community consultation in July 2024 and formal consideration by Council in September 2024, the By-Law was submitted to the Legislative Review Committee - a necessary step before a By-Law can be gazetted and come into effect.
In December 2024, the Committee advised that Clause 9.2 of By-Law No. 7: Cats "did not make sense" and suggested alternative wording. Specifically, they recommended inserting the phrase "is wandering at large" after the words “if the cat” to clarify the clause's intent. This change would be enough to trigger a re-start to the review process.
Acting on advice from Council's Lawyers - rather than restart a full review, Council has taken the opportunity to introduce a new By-Law - By-Law No. 8: Miscellaneous Amendments to allow for a streamlined mechanism to make the necessary minor corrections to By-Law No 7: Cats without triggering a complete review of the original By-Law.
Council is now seeking feedback on By-Law No. 8: Miscellaneous Amendments.
